By signing up for Text The Coach’s services, you agree to the following terms and conditions:
- Assumption of Risk: You acknowledge that participation in sports and exercises involves inherent risks and dangers, including the risk of personal injury or health-related issues. You assume full responsibility for these risks and agree to participate at your own risk.
- Health Statement: You confirm that you are in good health and physically capable of participating in the fitness classes or activities. If you have any pre-existing medical conditions or concerns, you must consult with a healthcare provider before participation.
- Professional Guidance: You acknowledge that it is advisable to seek professional medical advice if you have any doubts about your ability to safely participate in sports . If needed, you should follow the guidance and restrictions set by your healthcare provider.
- Proper Use of Equipment: You agree to use any equipment in the manner intended and follow all instructions provided by the instructors or staff. Failure to do so may increase the risk of injury.
- Waiver of Liability: You agree to waive, release, and discharge Text The Coach its instructors, staff, and affiliates from any claims, liabilities, or demands that may arise from your participation, including any claims related to personal injury or loss of property, whether caused by negligence or otherwise.
- Consent to Medical Treatment: You consent to receive medical treatment in the event of injury, accident, or illness during any fitness activity, and you agree to be financially responsible for the cost of any such treatment.
- Results Agreement: You agree that TextTheCoach is not responsible for the results that may happen with your athlete after given advice by our system. Text The Coach is not responsible for athlete failure at any level and is out of our control.
- Extreme Heat/Cold + other weather conditions: You agree to only participate in conditions that are suitable for activities. You agree to only participate in conditions where the athlete is not at risk of injuring themselves because of unsafe conditions. TextTheCoach will not advise you to participate in any unsafe conditions or environments nor are we liable.
COMMUNICATION WITH MINORS (UNDER 18)
Coaches are to run their sports mentorship through the parents of the athlete. Coaches are welcome to have direct contact with any athlete below the age of 18 (minor) ONLY if Account Holder (parent) is present in the chat AND/OR a TextTheCoach Administrator.
A group chat with athlete (minor), Coach, Administrator, Parent, etc. is welcomed, but under no uncertain terms should there be any direct contact from a Coach to an athlete under the age of 18 without supervision
.Should this happen the contract of both the Coach and the account holder will be null in void with no refund.
We welcome communication directly with our younger athletes, and it is the crux of our business but we protect them first and foremost with a checks and balances system for both parties.
